The point of purchasing the downpipe without the flange is to be able to fit it to turbos that come with varying outlet flanges (not just the standard Ford 5 bolt outlet flange), varying exhaust housing lengths, etc. The idea is that you are supposed to test fit, trim the length going to the turbo to ensure firewall clearance (depending on exhaust housing length), hold the downpipe in proper alignment with the trans crossmember so it fits under the car properly, and then tack weld it in place to ensure proper fitment. We actually include a little extra length at the turbo (relative to what most Holsets require) because it's really easy for customers to cut off extra length but it's very difficult for them to add extra length when needed. For a Garrett based turbo with a shorter exhaust housing design, it is the proper length where it connects to the turbo as-shipped.
If you simply weld a flange to it without ever test fitting it first to ensure fitment, you'll run into problems like those shown in your pics. Looks like you need to cut about 1.5" from the pipe at the turbo flange weld, then wrap a spacer (2-3 layers of cardboard, folded shop wrags, bubble wrap, rubber, etc.) around the end of the downpipe where it meets the crossmember so you can hold it against the crossmember and once you remove the spacer after welding, there is a 1/2" gap for proper clearance. Once you've got this done, then tack it, let it cool, then remove and finish weld on a bench so you can get all the way around the pipe.
On second look, it appears you expanded the end of the downpipe at the crossmember so it would slide over a 3" pipe. Is that correct?

yes thats correct it came from shipping with the end all messed up so i expanded it had no choice really. okay i kind of figuring id have to remove some pipe at the flange just wanted to check before i went crazy cutting it up
